This Privacy Notice fully complies with Mexican laws such as the FEDERAL LAW ON THE PROTECTION OF PERSONAL DATA HELD BY PRIVATE PARTIES, its regulations, and other applicable national provisions (“LFPDPP”), due to the nature and location of the company “Miss Marce.” However, for greater care and diligence in the field of personal data privacy and in line with international regulations, this Privacy Notice also complies with the applicable legislation of the EUROPEAN UNION, the GENERAL DATA PROTECTION REGULATION (GDPR), as well as the laws regulated by the UNITED STATES FEDERAL TRADE COMMISSION (FTC) regarding privacy policies and legitimate use of social networks. Such regulations, under certain specific circumstances, have extraterritorial application. Miss Marce is committed to operating under the highest standards of legality and ethics in the collection and processing of your personal data, ensuring that its treatment is controlled, informed, and legitimate to guarantee your privacy.

DATA THAT MAY BE COLLECTED

Miss Marce may collect personal data deemed necessary to provide its services, either directly from the data subject, or through electronic, optical, audio, visual, or other technological means. The information collected may be used to help us offer, provide, and/or improve our services. Miss Marce informs you that we do not handle or store your financial data.

What personal data do we collect?
To achieve the purposes described in this Privacy Notice, the following personal data may be collected directly: full name, address, phone number, email, age, gender, date of birth, RFC, CURP, and other general identification data. Indirectly, through third-party forms or providers, your data may also be processed, but only with your prior consent.

What happens to my financial data when paying for a service?
Financial data (bank account numbers, credit or debit card details, expiration dates, CVC verification codes, etc.) are not processed or stored by Miss Marce. Instead, they are securely (encrypted) processed and stored by the payment operator managing the Shopify platform. For more details, consult:

TRANSFER OF PERSONAL DATA

Miss Marce does not sell, assign, or transfer your personal data to third parties without your prior consent. National or international transfers of data may only take place without the data subject’s consent if such transfer is provided for by a law and/or treaty to which Mexico is a party, or by applicable international laws such as the GDPR.

EXERCISING ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION, AND OPPOSITION)

According to the law, you have the following rights:

Access: Know what personal data Miss Marce holds, the purposes for which it is used, and the conditions of such use.
Rectification: Request corrections to your personal information if it is outdated, inaccurate, or incomplete.
Cancellation: Request deletion of your information from records or databases if it is not being used in accordance with the principles, duties, and obligations established by law.
Opposition: Object to the use of your personal data for specific purposes.

Exercising any of these rights is not a prerequisite for exercising another. If you do not expressly oppose through an ARCO rights revocation request, it is understood that you consent to the processing of your data.

You may revoke the consent you have granted to Miss Marce for the processing of your personal data at any time. However, in certain cases, Miss Marce may not be able to comply immediately due to legal obligations. Revoking consent may also affect your ability to continue receiving services.

To exercise your ARCO rights, you must submit a written request describing in detail what you are requesting and provide an email for notification of the response.

Your request must include your name, address, a copy of your official ID (passport or voter card), a clear and precise description of the data you wish to access, rectify, cancel, or oppose, and any additional information that helps locate your data. If submitted by a representative, a power of attorney signed before two witnesses or notarized must also be provided along with the representative’s official ID.

GDPR DATA PROTECTION FOR RESIDENTS OF THE EUROPEAN UNION

This Privacy Notice complies with GDPR requirements. The protection of individuals regarding personal data processing is a fundamental right. Article 8, paragraph 1 of the Charter of Fundamental Rights of the European Union and Article 16, paragraph 1 of the Treaty on the Functioning of the European Union establish that everyone has the right to the protection of personal data concerning them.

How do we collect your personal data?
In principle, all data processed is provided voluntarily by you. If the personal data belongs to a third party, you guarantee that you have informed them of this Privacy Notice and obtained their consent. You are liable for any damages, direct or indirect, that may arise from failure to comply with this obligation.

DATA STORAGE AND SECURITY

Miss Marce implements technical, administrative, and physical security measures to protect your personal data and prevent damage, loss, alteration, destruction, or unauthorized use, access, or processing. Only authorized personnel, bound by confidentiality obligations, may handle your data. Confidentiality obligations remain even after the end of the relationship with Miss Marce.

When making a purchase on our website: www.missmarce.mx, Miss Marce transmits the full credit card number to the corresponding card entity for order processing. It is the client’s responsibility to protect against unauthorized third-party access to their password and computer. After each session, clients must ensure they have logged out.

Miss Marce stores information, including personal data, on its own servers and also on servers of contracted third-party service providers. Data may be stored in Mexico and in other countries where Miss Marce’s providers operate. If you are in the European Union or other regions with strict data laws, you acknowledge that Miss Marce and its providers may transfer, process, and store your personal data in Mexico and other countries, under the applicable privacy laws there.
